Quick overview of no-fault insurance

A Quick Overview of No-fault insurance in an auto accident

One of the most common cases we see are motor vehicle accidents which deal with No-Fault Insurance. What people in New York state might not know is when you have a motor vehicle accident the company that is responsible for paying your medical bills and responsible for paying your lost wages is your own car insurance. When you need to take time off of work to recover, when you need medical attention, it’s your own insurance that will cover those costs, that is why New York is called a no-fault state. For purposes of obtaining these benefits, even the person that causes the accident can get these benefits.

The state of New York also requires registered motor vehicles to have liability insurance with certain minimum coverage amounts:

  • $25,000/$50,000 for bodily injury per person
  • $25,000/$50,000 for Supplemental Uninsured/Underinsured
  • $10,000 for property damage per accident

First Things to do

One of the first things to do with your case is to make sure you have all the proper paperwork filled out for New York State, and proper paperwork filled out for your own insurance company, and it all has to be done within thirty days. If the proper paperwork is not filled out within thirty days you could lose those benefits. Having an attorney to help you with this can be beneficial as they will work tirelessly with your no-fault company to get your bills paid, to get you lost wage checks, to make sure you do not have to pay a penny for medical expenses, and to make sure your doctors know what is going on with your case.
